Omnicast Studio Class Action Case
Posted by: tom (---.proxy.aol.com)

I paid Omnicast/Atlantis Studios $8000 to be on their gaming showcase. This was paid in April of 2002 and I still haven't received any airtime. I spoke with an attorney in Washington, D.C. today and we are forming a Class Action Case. If you have been misrepresented by Omnicast/ Atlantis Studios, send me an email. I will give you the details of the case.
Respectfully,

Hi Tom,
I just thought I would leave a reply to give an overview of my experience with Omnicast, mainly for the archival purposes, should any industry new comers see this in the future and hopefully allow it to prevent them from getting involved with these clowns.
During the end of Summer 2001, we were beginning to line up sponsors for our pilot episode of the World's Best Cyber Casinos, which was broadcast in January 2002. When selling this show, it was immediately apparent that something was wrong, as all previous shows we had ever done were always sold out within a couple of phone calls, and we just couldn't get anywhere with this one for some reason.
During the course of investigating what the problem was, I had a few people come back to me to say that there was a similar company in Florida who was burning people by taking in cash but never actually purchasing air time. Eventually, I was able to identify this group as Omnicast, more specifically, as Marc Schechter.
On my initial investigations into Omnicast, there were two things that immediately came to my attention. The first was that they were running print ads that were intentionally misleading and deceptive, which is an act of fraud in itself. The second was the both the company and the managers of the company also had a Cease & Desist order (only a few months old at the time) for securities fraud in Pennsylvania.
I posted this information, and appropriate links, as a reply to a message board post at Winner Online where someone was asking if anyone ever heard of Omnicast. Marc S's answer was to try to turn it around and point the finger at me, which did not work and only got him investigated more, as I am somewhat respected by some of the regulars there.
He immediately filed an erroneous lawsuit against me, but rather than spending $50 to figure out where I lived, he just took the internic information from the Gaming Broadcast web site and had an associate served with court papers listing my name. Obviously, this is foolish, and it got kicked out of court without me ever even having to reply. He shoud have served me directly. But then, they say that an attorney who represents himself has a fool for a client, and Schechter certainly proved this to be true.
He was also shocked to see how easy it is for someone to do a keyword search on Omnicast Media to find that SEC violation, so he immediately transferred everything under Jason's name at Atlantis studios. Personally, I say get all of the documents out on the net that you can to link those two company names, and also advise the Penn SEC about his company name change. By the way, this is the 2nd such name change that they have done in the last 3 years. I'll be happy to address the company they were listed under before Omnicast if you like.
I had intended on filing suit against him myself, not only for the loss of business due to his fraud, but also because of his public defamation of my character and also for filing erroneous charges against me that listed flat out lies in his complaint and also falsified documents included in his complaint to try to prove his case. I honestly have more important things to do with my time than play around with a bunch of amateurs like them, but if your attorney wants to tack these things on to jack up the dollar value, I'll be happy to sign off on whatever he needs.

Dear Jerry,
Thank you for your insight. I wish had known alittle earlier, but it's my own fault for not doing my homework. I did speak to Kathy Mueller with the enforcement agency of Pa. She has referred me to her associate in Md. I also found another lady who paid MEA Productions under Marc Schechter $3500 with the same outcome. I will email you directly tonight and see if we can talk.
Anyone else who has been ripped off by Marc schechter, please step up and we can make this case worthwhile.
Thank you,

I've been preaching this for a while.....

I've been saying this OVER and OVER and OVER
WATCH who you deal with in this business. Trust NO ONE.
From the StartCasino PITFALLS page directly: <b>"Despite all the promises and ambitions this industry seems to offer, there are numerous con artists, scam operators and disreputable people in this industry (some with criminal records). Keep in mind, this industry is NOT regulated. Therefore, it would be short sighted to think that everyone in this business is honest. Some firms claiming to be the most reputable and honorable in terms of casinos and business are in fact out to rip everyone off. Despite their glowing and trusting appearance, they are the opposite in every way. Some internet casino and sportsbook companies do not abide by agreements in the form of contracts they sign."</b>
Yes, even I fell victim more than once in this business to scheisters. Its a rare find out there when you deal with this industry and someone in this business (as I have been for 5 years) doesn't get burned at some point.
Sometimes companies are bad to start with. Sometimes, when times are tough (like now) individuals change hats from White to Black. Recently, I experienced a company that did this.
But that doesn't detract me and shouldn't others from the business. There are honest people out there with integrity. Plenty of people as a matter of fact. I know Jerry Garner - he's reputable and he got bumed from the whole episode.
I also did business with Omnicast as well in the past. At that time, they were recommended to me from someone in the industry I respect. Despite obvious warning signs of what I saw as unprofessionalism, I unfortunately continued to deal with them for a short period.
We all make mistakes sometimes........ 'nuff said.

Today Marc Schechter agreed to give me back $4500 and rerun my commercial on his next gaming show case. I am going to take the $3500 loss as learning experience in the gaming industry. I am also going to drop the case against Omnicast. I would like to thank everyone who called or emailed me their experiences with Omnicast. I would also like to thank the webmaster for his input. I think the startcasino message board is an excellent place to go if you are thinking about a major decision in the gaming industry.

Its one thing for someone to "agree to give you back the money" - its another to receive it.
Have you received the cash.?

That's great news Tom. I'm actually a little suprised to see that you got through to him. I got an email from someone a few days ago wondering if they were still in business because it seemed like every number was off the hook. Maybe they had some kind of massive phone problem in the area or something. Just keep a sharp eye on them.

So, did they ever actually give you that other video placement? Make sure to get information from them as to when you can see it on television locally so that you can know for sure that it goes out.
The reason I ask is that their web site is now down, and I know other people appeared to have the impression that their telephones were disconnected. I noticed a while back that they changed their website from GamingShowcaseTV.com to just GamingShowcase.com. The first site has nothing at all there now, and the second just says "This web site is no longer active!". With that in mind, I'm not sure how confident I would be that there will be a future production.

Jerry,
I have just started calling Marc today for my second payment. I am not sure what Omnicast is up to. Marc told me 2 weeks ago he was down 4 employees. I don't really care about the next production. I am more concerned about collecting my next two payments.

I purchased 5 minutes of airtime for my product from Atlantis Studios in Boca Raton FL. The Executive Director is Marc Schechter. As of today May 27 2008 I have no evidence that the program aired and have received no sales. I was told that the segment would air to 22 million homes over a period of two months starting in April 2008. I paid them $5,000 and to date got nothing in return. Could this be the same Marc Schechter.

Marc Schechter is back, eh?
Oh well. It looks like people are finding about him here. I received a call last week about it.
I found some more info....so here it is Joe for your lawyers:
1) Company is in FL, but another company, Internet Capital Ventures & Assoc, was located in Pennsylvania. Documents were filed 2000-2001
Schechter Marc, et al. · SC 13D · Internet Capital Ventures & Assoc Inc · On 6/28/01
2) More info on all SEC filings on Internet Capital Ventures & Assoc
can be found HERE.
3) http://sites.state.pa.us/PA_Exec/Securities/actions/omnicast.html
Note - the link above is dead. I have submitted a request to the State of Pennsylvania's Securities Commission to let me know where the link is and what else is 'in the works.'
This is what the link used to say:
Quote:
For Immediate Release: August 22, 2001
Commission Halts Unregistered Activity
By Omnicast Media Group Corporation
Harrisburg, PA, August 22, 2001 - - To halt the offer and sale of securities by an unregistered agent in Pennsylvania, the Pennsylvania Securities Commission issued a Summary Order to Cease and Desist against Omnicast Media Group Corporation (Omnicast), Marc Schechter, President of Omnicast, Elizabeth Schechter, Secretary of Omnicast, Byron G. Ellison, Omnicast's Assistant Secretary, Michael Predmast, Omnicast's Executive Vice President of Marketing, and Walt Lippman, an agent of Omnicast. Located in Deerfield Beach and Boca Raton, FL, Omnicast is a start-up company which intends to operate as an integrated media company with a production division, a music division and an Internet division.
In June 2001, Lippman offered for sale to at least one Pennsylvania resident units comprised of 25,000 shares of common stock of Omnicast at $2.00 per share. Lippman told the PA resident that he receives shares of Omnicast stock for finding investors and he offered the gift of additional Omnicast stock if the PA resident found investors for Omnicast. Offering materials from Omnicast indicate that the issuer is offering 20 units of Omnicast common stock with each unit comprised of 25,000 shares at $50,000 per unit (Unit) for an aggregate offering amount of $1 million.
The Commission directed the respondents and affiliates to make no further solicitations or sales in Pennsylvania. The Units issued by Omnicast are securities under the Pennsylvania Securities Act of 1972. Lippman is employed by the respondents to represent Omnicast for compensation in the offer and sale of the Units, while he is not registered as an agent in Pennsylvania.
Any further solicitations or sales made by these respondents or their affiliates in Pennsylvania will constitute further violations of the 1972 Act.
